Agreement to Terms

By accessing or using our website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Services

Matteson Marketing provides digital marketing services including but not limited to: Google Ads management, Meta advertising, web design, graphic design, email marketing, and Google My Business optimization. The specific scope of services will be outlined in your service agreement.

Payment Terms

By purchasing our services, you agree to the following payment terms:

  • Payment is due upon invoice unless otherwise specified in your service agreement
  • Recurring services are billed monthly in advance
  • Ad spend budgets are separate from service fees and are paid directly to advertising platforms or as outlined in your agreement
  • Late payments may result in service suspension and applicable late fees

Late Fees and Interest

To ensure timely payment and maintain service continuity, the following late fee and interest policies apply:

  • Late Fee: A $25.00 late fee will be applied to any invoice that remains unpaid ten (10) or more days past the due date. This fee is applied once per invoice.
  • Interest Charges: For invoices that remain unpaid thirty (30) or more days past the due date, interest will accrue at a rate of 5% per month (compounded monthly) on the total outstanding balance, including any previously applied late fees.
  • Legacy Invoices: For clients migrated from our previous billing system, any outstanding balances will be subject to the same late fee and interest policies based on the original due date of the invoice.

Refund Policy

All sales are final. We do not offer refunds for services rendered. Once work has begun on your project or marketing campaigns have been launched, fees are non-refundable. We encourage you to review all service details carefully before purchasing.

Cancellation Policy

For recurring services (monthly retainers, ongoing ad management, etc.):

A minimum of thirty (30) days written notice is required to cancel services.

  • Notice must be provided in writing via email to hello@mattesonmarketing.com
  • You will be responsible for payment through the end of your notice period
  • Active ad campaigns will be paused or transferred according to your instructions
  • One-time project services (web design, single campaigns) are not subject to cancellation once work has begun

Client Responsibilities

To ensure successful delivery of our services, you agree to:

  • Provide accurate and complete information about your business
  • Grant necessary access to accounts and platforms as required
  • Respond to requests for feedback and approvals in a timely manner
  • Ensure all content and materials you provide do not infringe on third-party rights

Intellectual Property

Upon full payment, you will own the deliverables created specifically for you (designs, copy, etc.). We retain the right to showcase work in our portfolio unless otherwise agreed. Any proprietary tools, templates, or methodologies remain the intellectual property of Matteson Marketing.

Limitation of Liability

Matteson Marketing is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service in question. We do not guarantee specific results from marketing campaigns, as performance depends on many factors outside our control.

Communications

By using our services, you consent to receive communications from us via email and, if you opt in, via text message (SMS). These may include service updates, invoices, marketing tips, and promotional offers. You may opt out of marketing communications at any time, but transactional communications are required while you are an active client.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.
